Terms of Service – botTalk

While you actively use its listening feature, botTalk captures microphone audio, applies voice-activity detection and optional speaker filtering on your device, and encodes selected speech segments as WAV audio. Those selected segments are sent over an encrypted connection to a botTalk-operated backend, which forwards them through OpenRouter and selected AI providers for transcription. Transcripts and relevant request context are then processed to generate AI suggestions delivered through connected earbuds or the app. Third-party services process data under their own terms and policies. Provider availability and Service features may change.

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. If you are under 18, you represent that you have your parent or guardian’s permission. The Service is not intended for children under 13.

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information and to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.

You agree that you will:

• Obtain all necessary consents from any individuals whose voices or conversations are captured, recorded, or processed using the Service. You are solely responsible for complying with all applicable recording and privacy laws (including one-party and all-party consent laws).
• Use the Service only for lawful purposes.
• Not use the Service to harass, harm, defraud, or violate the rights of others.
• Not attempt to reverse-engineer, abuse, or overload the Service.
• Not use AI-generated content as professional, legal, medical, financial, or other specialized advice.
• Not use the Service while located in a jurisdiction where botTalk has not made the Service available, including the European Economic Area and United Kingdom.

All suggestions, responses, transcriptions, and other outputs generated by the Service are produced by artificial intelligence and may contain errors, inaccuracies, or inappropriate content. botTalk and its providers make no warranties regarding the accuracy, completeness, or suitability of any AI output. You use such content at your own risk. The Service is a tool for assistance only and does not replace professional judgment or advice.

Your use of the Service is also governed by our Privacy Policy. By using the listening feature, you consent to the audio processing described there.

Conversation history is encrypted and stored only in botTalk's app-private storage on your device. It is partitioned by the account used on that app installation; it is not synced to, or backed up by, botTalk. Logging out does not erase that account's local history, but another account using the same installation cannot view it.

Uninstalling botTalk or clearing its app storage permanently deletes all local conversation history. Reinstalling the app or signing in again cannot restore that history. Uninstalling the app does not by itself delete your online botTalk account; use Delete Account in the app before uninstalling if you also want the account deleted.

We use reasonable safeguards, but no system is completely secure.

Certain features require a paid subscription or viewing advertisements to obtain additional daily usage. Subscription fees are billed in advance and are generally non-refundable except where required by law. We reserve the right to change pricing with notice. Failure to pay may result in loss of premium features.

The Service, including its software, design, logos, and content (excluding user-generated or AI-generated outputs you create), is owned by botTalk or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes in accordance with these Terms.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOTTALK, ITS OWNERS, EMPLOYEES, AND PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF YOUR USE OF THE SERVICE, INCLUDING ANY RELIANCE ON AI-GENERATED CONTENT OR ANY FAILURE TO OBTAIN PROPER CONSENT FOR RECORDINGS. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (OR $100 IF YOU HAVE NOT PAID ANYTHING).

You agree to indemnify and hold harmless botTalk and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your violation of these Terms, or your failure to obtain required consents for audio capture.

We may suspend or terminate your access, including for violation of these Terms. You may delete your account through the app. Successful account deletion removes the account profile and account-linked voice profile from systems we control and instructs the app to delete that account's local conversation history and local voice profile. Pseudonymous installation, usage-accounting, fraud-prevention, security, transaction, and legal-compliance records may be retained when reasonably necessary and permitted by law; these records are not server-side conversation history. Upon termination, your right to use the Service ends immediately.

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms. Material changes will be notified via the app or email when practicable.

These Terms are governed by the laws within Utah’s jurisdiction and the United States of America, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in the state of Utah within the United States.
